Regulations

This site follows the legislation for the sale of alcoholic products is prohibited to minors under the age of 18. With reference to the law of 08 November 2012 which implemented the legislative decree of 13 September 2012 n° 158, the sale of alcoholic products is prohibited to minors, therefore the user who makes a purchase of wines declares be of age according to the legislation of the country of residence and the rules applicable to the latter. The user also declares that whoever receives the alcoholic product will be of age according to the legislation in force in the state from which the order and delivery takes place. Please note that, continues the Inspectorate, by consumer pursuant to article 1 c.2 of Legislative Decree 109/92 we mean “the private consumer as well as restaurants, hospitals, canteens and other similar communities”. Furthermore, the Regulation, in the provisions in question, when it refers to the “consumer” (art.22) and “final consumer” (art.37), does not seem to mean only the private one. In fact, when he intended to refer to this figure he used the specific term “private consumers” (see art. 11 relating to the exemption from submitting the stock declaration). Therefore, concludes the Ministry, it is believed that the retailers and sales points in question, for the purposes of exemption from the wine register, can make sales not only to private consumers but also to other professional operators (restaurants, bars, etc.)
